TERMS AND CONDITIONS OF SALE

The general conditions of sale detailed below apply to all orders placed with the company “fleurs-clementine.com”, in partnership with “Seekf” and “Fleurs et Clémentine”, in expect of all products and services offered on the website fleurs-clementine.com, except for any prior written agreement to the contrary.

Article 1 - General Notice
The general terms and conditions of sale are systematically brought to the attention of every purchaser in order to enable orders to be placed.
As a result, placing an order implies complete and unreserved agreement on behalf of the purchaser to these general terms and conditions to the exclusion of any other document such as prospectuses or catalogues issued by the vendor which serve only as a guide.
Any different conditions imposed by a purchaser will therefore, unless expressly agreed in writing, not be binding on the vendor howsoever or whensoever imposed.
If the vendor does not exercise all the terms and conditions of sale for whatever reason, this cannot be interpreted as a waiver of all rights to such terms and conditions.

Article 2 - Placing of orders
Information provided by the buyer, during the placing of orders are binding on the buyer: in case of error in the address of the addressee, the vendor cannot be held responsible if delivery of the goods is just not possible.
Orders are only considered as confirmed when they have been paid for in full by the purchaser.
Any amendment or cancellation of an order by a buyer cannot be accepted and no refund will be made. Supply of goods is subject to availability of the stock concerned.
Any product that has become unavailable will be automatically withdrawn from the on-line catalogue.
In the case of shortfall of stock, the vendor deserves the right to supply products with identical characteristics as to size and quality.
Photographs of products presented on the site fleurs-clementine.com do not represent any binding contractual obligation.

Article 3 - Delivery
In the case of an incomplete or incorrect address or lack of information making delivery of the product to the addressee impossible within normal delivery times, fleurs-clementine.com cannot be held responsible for the final quality of the product of the delivery in question. If incomplete address information results in a subsequent delivery, fleurs-clementine.com reserves the right to charge the client accordingly.

Delivery within metropolitan France is considered complete by supply of the product to the addressee evidenced by a note of receipt signed by the addressee, or in the case of absence, by a note confirming availability. Cancellation must be advised within 24 working hours by virtue of the perishable nature of the product. Any delay to delivery will be notified as accurately as possible. Failure to deliver within specified times cannot result in claims for interest and damages.

However, if 4 hours after the due time delivery has not been effected, for any other reason than force majeure, the sale may then be cancelled and the purchaser may obtain a refund of the purchase price to the exclusion of any other indemnification, damages or interest claim.

Force majeure is considered to be any of war, riot, fire, strikes, accidents or any inability to source the specified stock. The vendor will advise the purchaser as soon as possible should any of the aforementioned cases be applicable.
In any event, delivery within specified time limits can only be made if the purchaser has fulfilled all his obligations to the vendor.

Article 4 – Receipts - Returns
Any claims relating to any product delivered must, when relating to fresh produce, be made at the latest within 48 hours of delivery.

Any return of goods must be by mutual agreement between vendor and purchaser. Any returns accepted by the vendor in case of any evident defect or delivery of the wrong goods, will entitle the purchaser to a replacement free of charge or a credit note to the same value, to the exclusion of any other indemnification, damages or interest claim. The product must be returned to the vendor in its original packaging within 48 hours.

Article 5 – Prices
Products are supplied at the price stated at the time the order is placed. Payment of this price is to be effected either by cheque, credit or debit card (Visa, Eurocard and MasterCard) at time of purchase or directly on the website fleurs-clementine.com by means of secure payment or by means of the phone number of the fleurs-clementine.com ordering service using a pre-order reference number.

Article 6 – Disputes
Returns or disputes will always receive our best attention, utmost good faith being presumed with respect to any such eventuality.

In case of dispute, clients will make any claim to the customer service division of fleurs-clementine.com either by telephone on 0820 881 086 (0.15 Euros per minute) or by e-mail to serviceclients@fleurs-clementine.com.
French law alone will prevail in any such cases.
